Climate Change Lawsuit

Postby HONDO74 » Sat Nov 10, 2018 11:05 pm

I wonder if we could get these same young people to file a lawsuit against the Federal Debt ??

An intriguing climate change lawsuit filed by a group of young people against the U.S. government.

The suit, filed in 2015 by 21 plaintiffs now ages 11 to 22, argues that the failure of government leaders to battle climate change violates their constitutional right to life, liberty, property and to a “stable climate system” that will sustain human life.

The Supreme Court refused to halt the case. But it said that the government could present arguments against the case before the 9th U.S. Circuit Court of Appeals in the future.

The top court’s ruling acknowledged that the suit involves a number of “unprecedented legal theories” — including a “due process right to certain climate conditions” and an “equal protection right to live in the same climate as enjoyed by prior generations.”

In the latest argument, Solicitor General Noel Francisco complained in a brief to the Supreme Court that the plaintiffs “seek nothing less than a complete transformation of the American energy system — including the abandonment of fossil fuels — ordered by a single district court at the behest” of a group of young people.

Julia Olson, lead council in the historic climate change case Juliana v. United States, explains why she founded Our Children’s Trust in support of young people. This groundbreaking lawsuit filed against the U.S. federal government by 21 youth plaintiffs and climate scientist James Hansen on behalf of current and future generations is slated to go to trial in fall 2018. The small non-profit organization has done most of the heavy lifting to set this case in motion, while also inspiring, guiding and catalyzing similar cases all over the world defending the rights of young people against government apathy and government support of the fossil fuel industry at the expense of public health.

Another waste of taxpayers money. If they win. Every politician will be sued by the opposite party. I believe somewhere it says. " Elected officials are free from lawsuits about legislation."

Absurd. Obviously prompted by parents or political group or both.

To do this wouldn't we need to return to a pre metals life style to do as requested?
If it is global warming that is the concern and it would be a return to lower temperatures
then some of us that like it warmer could then sue in response.
Seems to me that this whole condition has been somewhat over simplified. We have
made great changes in pollution already in the U.S. Many in the rest of the world need
to so the same and match what we have done. I still contend that we do not know what
the temperature of the Earth should be, only thay it has been rising for @ 500 years.
This suit sounds like a way to disrupt the workings of the country and for a large
number of lawyers to make money.

Defination of waste:

A busload of lawyers going over a cliff with two empty seats.

No, the real shame was that it was a brand new bus.

In 1923, there was concern about a new ice age and Captain Donald Baxter MacMillan sailed toward the Arctic sponsored by the National Geographical Society to look for evidence of advancing glaciers.

Concerns that a new ice age was approaching was revived in the 1950s. During the Cold War, there were concerns by Harry Wexler that setting off atom bombs could be hastening a new ice age from a nuclear winter scenario.

J. Murray Mitchell showed as early as 1963 a multidecadal cooling since about 1940. At a conference on climate change held in Boulder, Colorado in 1965, evidence supporting Milankovitch cycles triggered speculation on how the calculated small changes in sunlight might somehow trigger ice ages. In 1966, Cesare Emiliani predicted that "a new glaciation will begin within a few thousand years."

On January 11, 1970, the Washington Post reported that "Colder Winters Held Dawn of New Ice Age".

Well, we stopped the New Ice Age. Maybe we could send the complainers to Antarctica where the ice cap is growing--then they could be happy.

"...Antarctica where the ice cap is growing." ???? Yes, I read that, too, that the ice on the sea is growing, and that the land is losing ice.
That's a very helpful link, Wayne. I had not been aware that there was a difference, in the melting ice regard, that it wasn't simply melting at both poles. I still am not sure about it because I continue to see reports by scientists that have stated Antarctica is losing great portions of ice, which are being broken off and cast adrift into the sea.

"Antarctica has lost three trillion tons of ice in the past 25 years, and that ice loss has accelerated rapidly over the last 25 yrs. " [www.livescience.com]

It will be intriguing to see what is gradually uncovered on the land; perhaps, Paleozoic and Mesozoic (!) flora and fauna fossils, from when Antarctica was part of Pangea !?

Maybe not them, particularly Tenelorn, but I suspect something besides rock is down there.

Maybe, even a ship. :? 8)

Yes, thanks for posting Wayne.

We watch just about every show on PBS and Netflix (BBC shows) having to do with the Arctic and Antarctica. We know more about the land, marine and plant life in those areas than I ever dreamed I would. But, I can't remember them ever saying that Antarctica was growing.... only that both polar regions were shrinking. Very misleading on their part, but I guess everyone spins their opinion, in a manner that will help their cause.

Not saying anything about global warming, just to the spin of these shows.
